1.1. Introduction

The website available at www.amsalumni.org is a site hosting the social and professional network created and managed by Antwerp Management School in order to allow graduates and students to keep in touch, to enhance training and promote employment and careers of alumni.

The website/platform is based on the AlumnForce - Alumni Network web solution. AlumnForce is a provider of community software for educational institutions and alumni associations, managing social and professional networks for students and graduates.


1.2. Acceptance of the agreement

By using our website/ platform you acknowledge that you have read and understood the Terms of Use, accept these Terms of Use and agree to be bound by them. If you don’t agree (or cannot comply with) the Terms of Use, then you may not use our website/platform.

When an account is created you will be asked to explicitly accept the Terms of Use by means of a clickwrap agreement. 

If you do not wish to accept these Terms of Use, please be aware that it is not possible to create an account. You may, however, continue to browse our website as described below.

2. Rules for users of the AMS Alumni website and platform

2.1. Rules for users

The following outlines to you what can and cannot be done on our website/platform.

The user of our services acknowledges having the skills and resources necessary to access this website/platform and that the used computer configuration contains no virus and is in perfect working condition.


a) Recommendations

Recommendation for the better use of our services:

-    FireFox version 10 or its last updated version;

-    A minimum screen resolution 1280 × 768 pixels. 

The Flash Player plugin version 9 or its last updated version might be required to download certain contents on the website/platform. This software may be downloaded from the Macromedia website (https://www.adobe.com/)


b) Anonymous users

Anonymous users may access the website, read articles and announcements on public events, but they cannot visit the profiles, post comments or participate in discussions. To visit the profiles, post comments or participate in discussions the user needs to create an account. 


c) Registered users

The user undertakes to register and to use a username or email address that doesn’t infringe the rights of third parties (family name, brand ...), or to use any name, company name or trademark without express authorization of the owner.

Each user is responsible for the personal account established on the date of its activation. The user is solely responsible for maintaining the confidentiality and security of their account and for all activities that occur on or through their account, and agrees to immediately notify us by sending an email to the administrator (alumni@ams.ac.be) of any security breach of their account.

To facilitate the use of the website and the reading of testimonials, the user should choose a clear title for their testimony. The user should also think to mention the geographic location in the subject, when useful. These details, anecdotes or emotions that you could convey, add value to your network.


d) Moderator

Users may notify to the moderator any non-conform message. The moderator can delete without prior notice any message which does not meet the conditions of the present Terms of use.

When possible, the testimony and comments should be written in English in order to facilitate their understanding by all members of the community. If necessary, the moderator reserves the right to translate the concerned text (in case a member or visitor has not translated the text before that!)

The moderator shall not moderate the messages in a way that could change their meaning. The moderator reserves the right of moving the message which is obviously placed in a wrong thematic group.

The moderator may refuse access to a community member if the member abuses his freedom of expression by making systematic and non-objective criticisms, intensively publishing information affecting the healthy atmosphere on the website, spamming and/or publishing facts against the law.


e) Suspension or termination

Antwerp Management School without any obligation to justify, reserves the right to suspend or terminate access to our services any user who harms our reputation and / or breaches the present Terms of Use.


f) Indemnification

Antwerp Management School shall not be responsible for any losses arising out of the unauthorized use of the account. All actions taken under this account are recorded and may be used in case of a dispute.


2.2. Users restrictions

The user must be a graduate, a student, a faculty or staff of Antwerp Management School and to have a valid email address and date of birth in order to activate their account.

The user confirms that any registration information they submit is true, accurate and complete, and agree to keep it that way at all times. 

For the respect and the good of everyone are deemed as prohibited: abusive, offensive, obscene messages, or defamatory content violating the rights of third parties, abusive language or language encouraging racism, pornography, pedophilia or crimes, the use of the website for purposes of propaganda, commercial prospecting or politics.


2.3. Payment and billing

The registration on the website/platform is free and effective as soon as the account is activated by the user. The registration implies the acceptance by the user of all conditions of the present Terms of use and our privacy policy.


2.4. User-generated content

Users may post, upload, or otherwise contribute to our services (which may include for example: pictures, texts, messages, information, and/or other types of content) (Hereinafter ‘User Content’). 

The user guarantees that the testimony, comments, pictures and data of any kind disclosed by the user on this website are free from third parties’ rights.

The user consents that, with respect to any ‘User Content’ the user posts on our website/platform, (1) the user owns or has the right tot post such User Content, and (2) such User Content, or its use by Antwerp Management School as contemplated by the Terms of Use, does not violate these Terms of User or any other rights set forth within the privacy policy, the applicable law, or the intellectual property, publicity, personality, or other rights of others or imply any affiliation with or endorsement of the user or the User Content by Antwerp Management School or any entity or individual without express written consent from Antwerp Management School or such entity or individual.

The user is solely responsible for all User Content they post. Antwerp Management School declines responsibility for User Content. 

The user expressly consents that their testimonies and comments may be reproduced and/or represented for free in the supports of communication aiming at promotion of Antwerp Management School. The user accepts that the above mentioned rights are granted during the legal term of protection of these comments and testimonials.

Antwerp Management School without any obligation to justify, reserves the right to delete any User Content that harms its reputation and/or breaches the present Terms of Use.


2.5. Termination of account

If you no longer wish to use your account or wish to have it removed, you can contact the administrator (alumni@ams.ac.be)  

Please write the following in the subject line of your email: "END ACCOUNT".


3. Intellectual property and copyrights

The texts, software, pictures, videos, databases and other developments on this website are protected by applicable intellectual property and other laws. The user agrees not to reproduce in any form or by any means the above listed contents and/or any information or materials under protection of intellectual property and other laws without the express permission of Antwerp Management School and/or the original property holder of such information and materials.

The content of the website, including all text, graphic and animated images, is the property of Antwerp Management School, its affiliates and/or the original property holders. Any total or partial representation of this website or any of its content in any form or by any means without the express authorization of Antwerp Management School is forbidden and shall constitute unauthorized reproduction punished by applicable laws of Belgium and international law.

Similarly, databases operated on the website are protected by the provisions of the applicable intellectual property laws.

These Terms of Use are not intended to confer any rights on anyone except you and Antwerp Management school. 


5. Legal terms

5.1. General disclaimer

We are not responsible for any malicious content such as malware, Trojan horses, or viruses, or otherwise that interferes with any user’s access to our services. 

Our website/platform is integrated with or may otherwise interact with third party applications, websites and services (‘Third party applications’) to make our services available to you. These Third Party applications may have their own terms of use and privacy policies and your use of these Third Party Applications will be governed by and subject to such terms and conditions. 

You understand and agree that we do not endorse and are not responsible or liable for the behavior, features, or content of any Third Party Applications, nor do we warrant the compatibility or continuing compatibility of the Third Party Application. 

We do not guarantee that the use of the website/platform will be uninterrupted or error-free. We are not liable for technical failures and data loss related to, or other damages or losses arising out of or in relation to the use of the website/platform by the user.

We agree to take special care about the veracity of information exchanged on the website and to keep it regularly updated. However, errors or omissions may occur. In this case, we kindly thank you to let us know about any error or abnormal information you may encounter when using the website so that necessary corrections could be done.

In no event shall the aggregate liability of AMS exceed the greater of one hundred EUR (€100.00). the limitations of this subsection shall apply to any theory of liability, whether based on warranty, contract, statute or otherwise, and whether or not AMS have been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.


5.3. Indemnification 

The messages and pictures are posted at the sole responsibility of the author, who is liable for and bears all consequences related thereto. More specifically, the author guarantees Antwerp Management School against all actions of third parties resulting out of or in connection with the content of the message posted by its author. The author of the message expressly accepts to cover any amount of all costs and expenses incurred by Antwerp Management School with respect to any claims resulting out or in connection with the content of the message posted by the author. Antwerp Management School disclaim any responsibility for the content or information posted by users.


5.4. Choice of law and jurisdiction

This website is governed by Belgian law and the exclusive jurisdiction of the Antwerp, division Antwerp courts for the resolution of any dispute, claim or controversy that relates to or arises in connection with these Terms of Use.

2.1. Personal data that you communicate to us:

•    Category 1: without registration and when visiting our website: your IP address and surfing behavior on our website, The entry site you used to reach our website and the search terms you used to find us online;

•    Category 2: Upon your application or enrollment as a student; your name, first name, date and place of birth, sex, national ID number, nationality, student history, bank account number, e-mail, company name and company ID, medical details, food allergies, dyslexia, dyscalculation

•    Category 3: Upon your registration: upon registration for our newsletter or request to receive a brochure, white paper or any other documentation or information: your name, e-mail, company name, company ID, your social media account if you contact us through social media

•    Category 4: As a supplier, partner, teacher, guest teacher: your company ID, name, first name, address, bank account, CV, e-mail

•    Category 5: Upon your participation in scientific research studies: your name, first name, address, e-mail and any data that is relevant in connection with the research project and/or that your provide us during the research. Scientific research may necessitate the processing of sensitive data (your origin, religion, political preferences, sexual preferences, trade union membership, …). In such event, we will ask for your explicit permission prior to any processing activity.

•    Category 6: During your stay with us as a student, guest, participant in events: camera footage, photo’s, papers, exam results and deliberations, CV, food preferences, vehicle license plate, date and time of arrival and departure, any specific information you may from time to time decide to share with us as a student, guest or participant in events.

•    Category 7: After your graduation and as part of our alumni activities: your name, e-mail, address, phone number, degree, graduate year


2.2. AMS can collect data from you (Personal Data) in different ways:

  1. Through the use of cookies on our website
  2. Upon your registration on our website
  3. Upon your enrollment or application as a student or for an event or as participant in scientific research programs
  4. Upon engaging in a relationship with you as a supplier, partner, teacher


Article 3 – Purposes of the processing

3.1. General purposes: AMS will only use the Personal Data collected by you for the following purposes:

•    Category 1: the maintenance and improvement of our Website and the inclusion of Personal Data in anonymous statistics, from which the identity of specific persons or companies cannot be determined, based on the legitimate interests of AMS to continuously improve its Website and services;

•    Category 2: Management of your student account during your study with us, with as legal basis the execution of a contract and, if so opted by you, sending of direct marketing with as legal basis your explicit prior consent;

•    Category 3: sending you direct marketing, newsletters, actions, promotions, with as a legal basis your explicit prior consent

•    Category 4: management of your supplier, partner or teacher account in view of administration and accounting & the delivery of certain services of your choice, with as a legal ground the execution of an agreement or, in the event of direct marketing, your prior explicit consent

•    Category 5: Scientific research, with as a legal basis the execution of an agreement and, to the extent possible, your prior explicit consent

•    Category 6: Ensuring our day-to-day operations as well as our communication and online and offline marketing with as a legal basis our legitimate interest and, to the extent possible, your prior explicit consent

•    Category 7: Our Alumni contacts with as a legal basis our legitimate interests and, to the extent possible, your prior explicit consent.

You are not obliged to provide us with your Personal Data, but you must understand that the provision of certain services becomes impossible if you refuse the processing.


3.2. Direct marketing:

The personal data may also be used for direct marketing of our services, provided you have given an additional explicit permission (“opt-in”) for this or you are an existing client of AMS and have not opted out or we use a non-personal e-mail address to contact you.

If you are already included in our mailing list for receiving marketing material in paper and / or electronic form, AMS can use your details for sending marketing and other material with regard to AMS, its products and / or services. AMS can use the information you provide for updating documents saved by AMS.

This permission can be withdrawn at any time, without justification and free of charge, for example by clicking on the appropriate cancellation link at the bottom of each promotional e-mail message.


3.3. Transfer to third parties:

AMS will reasonably attempt to inform you in advance of the fact that AMS will disclose your information to the said third parties, but you also acknowledge that this is not always technically or commercially feasible under all circumstances and that the information above is sufficient to inform you of the possibility of any data transfer we might envision.

AMS may also exchange your data with government agencies, University of Antwerp, other universities or colleges, scientific institutions, our software- and hosting providers, our various service providers, our teaching staff, …

AMS will not sell your Personal Data, nor rent, distribute or otherwise make commercially available to third parties, except as described above or with your prior consent.

In the event of full or partial reorganization or transfer of activities of AMS, where it reorganizes, transfers, ceases its activities or if AMS goes bankrupt, this may mean that your data will be transferred to new entities or third parties through which the business activities of AMS are wholly or partially carried out, transferred.


3.4. Legal requirements:

In rare cases, AMS may have to disclose your Personal Data pursuant to a court order or to comply with other mandatory laws or regulations. AMS will reasonably attempt to inform you in advance in this respect, unless this is subject to legal restrictions.


Article 4 – Duration of the processing

All data is stored and processed by us for a period that is necessary depending of the Purpose of the processing and in function of any contractual relationship between AMS and yourself.

•    Category 1: Your data is stored for the duration of your internet session and is anonymized afterwards.

•    Category 2: Your data is stored up until 7 years after your graduation. Your bank account, accounting information, social law data and tax details will be stored for the relevant periods as prescribed by applicable law. Study points, copies of certificates and diploma will be kept an unlimited period of time.

•    Category 3: Your data is stored up until 4 years after your last contact with us (request for information, download, registration for an event, …)

•    Category 4: Your accounting, social and tax data are stored for the relevant periods as prescribed by applicable law. Your contact details will be stored up until 15 years after the end of your relationship with AMS

•    Category 5: Your data is stored indeterminately, for reasons of future scientific research

•    Category 6: Your data is stored for the storage periods prescribed by law (camera security) of on a case by case assessment basis for the duration required for our internal operations

•    Category 7: Your data is stored indeterminately, for reasons of future alumni activities and follow-up.


Article 5 – Your rights

5.1. Right of access and information:

You have the right to receive free access to your personal data at any time, as well as to be informed of the use we make of your personal data.


5.2. Right of improvement, deletion and limitation of the processing:

You are free to decide not to communicate your personal data to AMS. You also have the right to request us to correct or delete your personal data. You acknowledge that in case of refusal of communication or if you request for the removal of personal data, certain services of the Website may not be available.

You may also request to limit the processing of your Personal Data.


5.3. Right to object:

You also have a right of opposition to the processing of your personal data for serious and legitimate

reasons.

In addition, you always have the right to oppose the use of your personal data for direct marketing purposes; in such a case you do not have to provide us with reasons for this demand.


5.4. Right of data portability:

You have the right to obtain your Personal Data processed by us in a structured, standard and machine-readable form and/or ask Us to transfer it to other Data controllers.

6.1. 6.2. Under no circumstances can AMS be held liable for any direct or indirect damage resulting from incorrect or unlawful use by a third party of your personal data.

6.3. You should respect our security regulations at all times, a.o. by preventing any unlawful use of or access to your account and passwords. You are sole responsible for the use of our website from your IP-address, device, password and account name.
